TUESDAY, AUGUST 20,
(Beforo Mr. AV. A. Barton, S.M.) Drunkenness.—A first offender was dealt witli in the usual manner.—
James Steedman was charged with being found drunk at To Kara'ka.—Constable Doylo stated I hat ho had arrested the accused, who appeared to he in a mild state of delirium tremens. —Accused was fined ss, with costs Us, in default 24 hours’ imprisonment. He was also ordered to pay 13s Gd for medical attendance.
Cycling on the Footpath.—Margaret Streets was convicted and fined the sum of 10s, costs 7s.—Peter Hansen was also fined 10s, costs 7s for a similar offcnco.
Breaking and Entering.—Thomas Banning Marshbank and Andrew Rain ago wore charged with breaking and entering the premises of Mr. James Erskine, baker, Gisborne, with intent to commit a crime therein.—Mr. Geo. Lysnar appeared for the accused.— Sarah Erskine deposed that she knew both accused, who had worked for her husband. AVas in the shop on lltli inst. between G and 7 in the evening. AA'hen sho left the shop slio locked everything up. There is a window over tho office door at the back of the shop, fastened with an ordinary catch. There was a hole in the glass largo enough to admit a man’s hand. AVitness left a brown hand-bag under tho counter. Sho went to the shop on the morning of the 12th about 7 o’clock, and found tho office window raised about 3ft and the drawers of the desks were all open. The brown hand-hag was on the office table, open. —By Mr. Lysnar: AVas sure the window was closed when she left the shop. There would he between 30 and 40 coppers left in the. till. There were signed cheques in the drawers in the office, but they had not been taken. Did not find the lads dishonest while in her husband’s employ.—Alfred Ernest Hart deposed that he was in the employ of Mr. D. Dustin. The two accused told him that they had done a daring thing the previous evening—that they had broken into Mr. Erskine’s shop. They told witness that' they could only find threepence and two cigars.—Detective Maddern deposed that on the morning of the 13th instant Constable Hancov and he ? arrested the accused Ramagr on the present charge. After he had spoken to the witness Hart, Ramagc said he wished to make a statement and witness took down in writing what he said, Ramage signing it. AA’itness and Constable Hancox then went to tho residence of Mrs. Tier in Briglit-stroet and found the door locked. Marshbank was inside in bed and witness told him that lie was to be arrested for breaking into Erskine’s shop. Accused was taken to the station and Ramage was brought in and the statement was read which Ramage had made. Marshbank said he would have his say and said that Ramage told him that Mrs. Erskine had a black-bag with a lot of money in it. Ramage denied having told him so. Marshbank then said that Ramage had bean the first to want to go in there. Ramage denied this also. At two o’clock Marshbank sent for witness and asked him to get Mrs. Erskine to come over and see him and he would settle it with her. AA’ifcness told him that Mrs. Erskine had nothing at all to do with it.—Asked by His AA’orship whether he bad anything to say, the accused Marshbank said he pleaded guilty to tho charge. The accused Ramage said ho was not guilty of the change of breaking and entering although he was outside the shop when Marshbank entered.—The accused, were committed to stand their trial at the next sitting of the Supreme Court. The question of bail in the case of accused Marshbank was deferred until next morning. Procuring Liquor.—Robert Grant Brown was charged with procuring liquor during the currency of a prohibition order. Accused pleaded guilty and was fined £5, costs 7s, in default 30 days’ imprisonment.
