AN APPEAL GRANTED.

RESPONSIBILITY OF' MILKMEN. Press Association. AUCKLAND, August 16. Before Mr. Justice Denniston an appeal was made by Samuel Wood, a milkman, against the decision of the magistrate in convioting him on a charge of mixing extraneous ingredients with milk, to wit, boric acid. Evidenco was given, and his Honor said there was no doubt the offence had been committed, but the question was as to whether it was the appellant who did it. Before a man could bo guilty of the offence of mixing lie must “mix,” and it was for the Crown to prove it. No proof, however, had been given. The appeal was allowed. His Honor said that if the effect of his decision was to render tho section useless, then perhaps the Legislature might legislate for them on the matter.
