SECOND-HAND DEALER'S ACCOUNT.

W. J. M. Attwood, second-hand dealer, sued Valentino Aston at the Magistrate's Court yesterday to roeovor £1 Os 2d, for goods purchased. Mr. R. U. Burke appeared for plaintiff.

Plaintiff stated that tho goods indicated in account (producod) wore sold by his father to defendant. Upon his father’s doath witnoss bought all tho book dobts. \ . mossed tho goods actually being deli. orod to defendant' on tho dates mentioned.

The prices were fair and reasonable. Witness producod his books showing corresponding statomont of claim. By defendant: Defendant’s wife purchased tho goods. A mnnglo was purchased for £2 6s and £1 \ crodit was shown for Nevembor when it was paid on 4th March. Admitted the mistake as to date, but it mado no difference as to amount. Mrs Aston agreed to pay interest at pjor cent on February 3rd when tho goods wore purchased. Defendant, giving evidence on his own behalf, said that tho mangle had been paid for in full. Denied receiving somo of tho articles.

Mr. Burlco said no evidence was given to show that tho goods delivered to defendant’s wife.

Plaintiff, recalled, said that tho goods were supplied to the wife. Defendant had no further payments. His Honor decided to give judgment for tho amount claimed, £4 6s 2d, and costs £1 125.,
