A GISBORNE LAND CASE.

A DISPUTED SURVEY. Press Association. AUCKLAND, last night. In tho Supreme Court Mr. Justice Cooper gave judgment in a summons brought by J. N. Williams against the District Land Registrar, Gisborne, to show cause why he should not issue a certificate of title under the Land Transfer Act in regard to the remainder of Ruangarebu blocx. The original block comprised 6878 acres, but 2478 acres were sold to the Crown, and at the same time a transfer of the remainder from J. N Williams to Herbert William Williams was effected. In regard to the balance of the land the District Land Registrar registered a transfer, but declined to issue a certificate until the accuracy of the survey was proved by another, as he Relieved the former survey to be incorrect. His Honor said it was clear that

having issued the original certificate the Registrar could not recall it to correct an error in tho description. Appellant had a clear statutory right to a certificate for the balance or alternatively, in the discretion ol the Registrar, to have handed to him the original certificate as to that portion of land transferred to

tho Crown. He made an order ill these terms, with £7 7s, costs of both parties to bo paid out of tho assurance fund.
