At Balclutha to-day, before Mr G. Cruiokshank, 8.M., charges against Qeo. Francis Greenwood and Geo. Fisher of having between certain dates kept alcoholic liquor for sale in a prohibition district were dismissed without prejudioe, on the contention of counsel for the defenoe that although the sale of liquors outside the district to defendants was proved, there was no evid6noe to prove it went into or was kept in a prohibition distriot. William Marshall was convicted of keeping liquor for sale in a no lioense distriot, and was sentenced to three months’ imprisonment with hard labor, Counsel for defenoe raised the point that there was no proof of liquor being in a no-lioense distriot, and asked for an adjournment to have the point settled, Ho declined to pat his olient in the witness box, as that would destroy his law point. The Magistrate said tho onus was on accused, and if he did not take the opportunity he would be convicted. Sentence was stayed for seven days to allow of an apgoal being proceeded with.
Michael Liston, on a similar charge, was fined i£so and costs, execution being stayed pending an appeal on the samo grounds as in the previous oars.
