A CHILD’S DEATH.
(Par Preen Association.) Dunedin, last night. As a result of the evidence given at the inquest held recently on a child who died as the result of glycerine and carbolic acid being administered instead of glycerine Sydney Smith, of the Friendly Societies dispensary, was yesterday charged witl selling a certain poison without firmly affixing to the bottle containing it a label with the word “ Poison ” on it in white letters on red ground. Counsel for defen dant raised four points on which h< claimed dismissal: (1) That the charge was not laid within six months, thougl he did not want to press that; (2) defendant was an employee, and did not come under the Act; .(3) there was no sale, ae each member of the different societies contributing to the dispensary is a member of it: (4) that the regulation in the Gazette was ultra vires. As the case wad of importance, the Magistrate reserved his decision.
