At tho mietiog of the Auekland Licensing Committeo tho renewal of 15 wholesale IioeDBEB was granted without objeo-
lion, Mr Baumo applied for tbo renewal o the wholesale licenßO of John Schisehka. The polico reportod adversely, holding that 11 John Schisehka is not a fit and proper person to hold a wholesale beers'. Mrßiumosaid the offence for which the applicant had bean recently punished jn the Supreme Court in oonnect : on with the sale of manure had nothing whatever to do with his business as the holder of a wholesale licet s’. The’ Clerk (Mr H. H. Ralfe) read a polios report to the effeot that the applicant had consigned three oases of whisky, deecribed as cordia’s, to Ngaruawabie, ; a nd that they had been repacked at Ngaruawabia and shipped in one case to Te Knit', in the Kmg Country. For that offence ho was fined £2O. Mr Baume explained that theropackiDg of the whißky for shipment to tbo King Country was not done by the apphoant, but by someone else. Schisehka was fined for a breaoh of the railway regulations in this matter, and not for sending liquor into the King Country. He did not do this kind of busiooss, and it would not suit him to do it. With regard to the other matter, that of the manure proseoutioD, surely the oommiltoe were not goiDg to ruin a man in his business for such a oanse. Scbisebka had been punished for that, and eurely this Bhonld be enough. It simply meant that because a man had onoe done wrong the oommittee would say he should have no opportunity of rising abovo it, and doing better. Tho Chairman: Tbo question is not what the applicant was punished for, but whether he is a fit and proper person to hold a wholesale license. Mr Rosser; We have to teke every reasonab'o care that ODly suitable perso-is are granted wholesale lioenses. I do nor thmk the applicant is a snitablo persoD, and I oontend that his license should not be renewed. The Chairman : Here we have records of the manure prooeediogs in the Sapreme Court. Is a man capable of doing what Sohisebka was found guilty of doing a fit and proper person to hold a wholesale -license? I hold not. We require that publicans should be well known and trust worthy persons, and unless they are jioonsoß are not granted or not renowed,
Mr Bftumo pressed for an adjournment until tho wholo matter oould be ventilated before tho oommiitoo. No objection to the ronowal was tnken until lost Saturday, and no time was allowod for getting matorial to pul before tho ooaimittoo in support of tho application being granted. Ho thought tho oommittoo woro going too far in rofusirg tho renewal of tho lioonse. Tho Chairman : Tho question, as I have already said, is not one of manure, but of tho fitoess of tho applicant. Mr Casey : Wo ought to hear him on the whisky ease. Perhaps tho counsel has not put all tho facts before us. Tho Chairman : Wo cannot not as a court of appeal. The Ngaruawnhia case has been settled, and wo cannot say whether tho magistrate thoro was right or wrong. Ho (Mr Dyor) opposed renewal. Mr Casey favored an adjournment, as it would bo a graoious act to hear what tho applicant bad to say. Mr Baumo applied for ntransfor. Tho Chairman : No ; that, I am sure, would not bo graDtod. Mr Choal : If it were it would bo transferred to some other name, but the business would be Sohioobka’s. The oomm'tteo unanimously deoidod to refu’e tho application, Mr Casey, Bfter expressing his reg ot at being powerless to seoure an adjournment, voting with the other members.
