Mr Nolan, for defendant, nilted there had been a technical ach of the by-law, but pointed out that iermit for driving sheep bad never been an in the Borough, not being thought pessary, The defendant had been inmed from the Council offioe that a pert was unnecessary. His Worship cl the by-law should be altered if it was isidered permits were not needed. As this was the first roseoution of tbo kind bo would infliot a omiual penalty of Is without costs.
