CLAIM FOR DAMAGES.
(Per Press Association.} Dunedio, last night, A case was commenced in the Supreme Court to-day, before Mr Justice Williams and a special jury, iu which Mrs Margaret Weir claimed £550 for injury sustained in a railway carriage on March 14th last.
Plaintiff was a Beoond class passenger by ‘the morning train from Burk’s to Dunedin. It was alleged that a brass plate with “ New Zealand Railways " on it was not properly screwed down, and on walking out plaintiff’s foot oaught in it. Sha was thrown towards the door, and' then there was a jolt of the train, and she was thrown back, the result being a severe fell and injury, and to this day she was more or less crippled. For the defence the evidence of Dr Marshall Macdonald was that tho woman was making the most of her injury. He came to the conclusion that she was suffering from rheumatio affeotion of the sciatio nerve, and rheumatism in the hip and back.
Evidence was given that Mrs Weir did not always use crutches, aud she appeared able to go up to the bush and out wood. Railway servants gave evidence that there could be no jolt when the train had once stopped. The case is not 000010464,
