AUCKLAND NEWS.

(Per Press Association. 1 ) Auckland, last night.

In prosecuting two Arch Hill shopkeepers named Albert Walford and Leslie I Vickers, in the Police Court to-day for neglecting to cloee their premises on the statutory Wednesday half-holiday, Mr Ferguson, factory inspector, declared to Mr Kettle, S.M., that pure greed and selfishness cansed defendants to keep open to get business at the expense of other shop keepers who were closing. He added that Walford and Vickers were personally ' warned of their responsibility,and Walford kept open after he was warned. Mr Singer, who* defended, stated that his clients were misled by a paragraph in the newspapers, which stated that by a curious anomaly Arch Hill was excluded from the provisions of the Shops and Offioes Act, His Worship decided that he would assume in favor of defendants that they acted mistakenly. It was very' foolish for I them to do so without consulting tbe inspector. He fined them £1 each, with costs.

In committing John Henry Fairball for trial on a charge of manslaughter by killing | Arthur Henry Burfoot in a fight,Mr Kettle S.M., remarked that be thought it his duty to do so, though he felt sorry for the man. It was a technical manslaughter ease, in his opinion, and he thought some preprovision should be mads bythe Legislature that Magistrates could deal with cases of this sort where there was a teebnioal crime j with no wrong motive. He allowed bail of £25.

Dr Arthur Herbert .Orpen was charged with unlawfully having used an instrument or other means to procure a miscarriage. He was remanded nntil Monday. The Crown Prosecutor said the woman was Dot fit to appear. Bail was allowed accused in £SGQ and two sureties of £250 each.

The racehorse Gladstone has been pur cha3ed by Mr C. Weal for SOOgns.
