SEWING MACHINE AGENT AWARDED £222,
[(Pec Press Association.) „ Auckland, last night. At the Supreme Court Mr Justice Edwards gavo judgment on the claim of Charles Baker for £SOO damages from the SiDger Manufacturing Company jfor wrongful arrest and proseoution. His Honor referred to evidence given in the case in which it was shown that the plainI tiff was addicted to drink, and discharged from his position. He left with the firm’s accountant an.IOU to cover about £2 14s deficiency on his part, and in addition to this the firm held £4l 3s 9d of plaintiff’s money in a guarantee fund. Yet he was prosecuted for the theft of money deficient and was committed for trial to the Supremo Court, where he was acquitted. It | was plain to His Honor that plaintiff had no felonious intention and to prosecute him under these circumstances was an abuse of the criminal law. He thought the case one for substantial, but not vindictive damages. He would assess the damages for plaintiff at £222 16s (which included £22 15s cost of his defence on the criminal side of Court) with costs.
