The Gisborne Times PUBLISHED EVERY MORNING. GISBORNE, APRIL 26, 1905. TO-DAY’S ELECTION.

An exciting, contest is promised for the Mayoralty, Mr W. D. Lysnar, again challenging New Zealand’s veteran Mayor, Mr, Uohn Towinley. Both, gentlemen have for years past been prominently, before the pfnblic, and each will have warm supporters in tne contest..

The candidates for the Co;uincil are representative oS the whole of the Borough, .and contain men shilled in, finance, in law, general business,, and in all classes of . practical work there is all the material for a Council that will reflect credit on the district.- It is to' bo hoped that all voterj will make am effort to record their votes, and that all- wilt be imbued with the hearty, desire to see ilia borough steadily progress'.

Captain Campbell resumed command of the Haupiri yesterday. The Kaiti-City footballers return by the Talune this afternoon. The owner of a brown gelding is advertised for. The Gisborne Gaß Company advertises winter fuel at 2s per sack.

In giving- judgment in the Abbotsfoi Smith maintenance case appeal N Justice Edwards said : I regret that I m forced to the conclusion that the ordc does not cover more than ono matter c complaint. There can be no doubt the separate complaints and separate order could have been made in support of th intended desertion of the complainant am each of tbe children. Section 18 of thi Destitute .Persons Act treats the intendec desertion of the wife as a Separate inattei from the desertion of the children- Thai there must be separate complaints in respect to the children, and in respect to each child, is the objection, and as two matters are dealt with in the order, I am reluctantly compelled to allow the appeal and “quash the order. This will bo sufficient to dispose of the case before me. But as there are no other objections which will be a bar to further proceedings, I certainly will not award the appellant any costs against ‘his destitute wife, whom I am of opinion ho intended to desert. The ease willV. doubtless come before the magistrate again, and it is difficult to see svhat benefit the appellant will derive from ais appeal. After the rowing was over on Saturday > meeting of delegates, representing the lawko’s Bay Bowing Association was leld at the Masonic Hotel, there being irasent : Messrs Bone, Napier 8.C., (in bo chair), A. L. Barnes, Union Secretary f the Association, L. Hay, Napier, J. Cato, Inion, H. Johnson aDd C. Hamilton, Gisnrnfl E.O..and A. Pritchard and W.

Fraser, Poverty Bay 8.0. The principal business was altering some of the machinery roles, and altering the constitution to admit outsiders into the Association. This rule provides that members outside can join on the payment of 10s 6d, and may if they require it be represented on the executive by one vice-president 'and two delegates. The reason of this innovation is to provide extra funds i towards the Association. The H.B. centre propose to hold a large regatta and carnival requiring a guarantee of £SOO at the end of tbe year, and this will£enable them to canvass among outsiders. Mr Barnes, in the course of his remarks, touched upon the necessity of the various clubs being represented on the Union by up to-date delegates—men who took sufficient interest in the affairs of ,the centre to attend the meetings held, as on some occasions these meetings had lapsed for want of a quorum. The new roles passed by the meeting will necessarily be forwarded to the N.Z. Bowing Association for confirmation before being printed, and will then be forwarded to 1 tbe various clubs belonging to ibo Association. After some minor business, the * meeting closed with a vote of thanks to 1 the chairman, IS

carrying with it a seat on the Harbor Board. There is good reason ito feel pleasq’d at the keen interest now being taken in the contest, and the list of candidates gives ample opportunity to make an excellent selection. Some worthy, Councillors are missing, from the list of candidates, hut well-known ex-Co uncillo r s are again offering their services, in addition, to a large number of business men who, are willing to take their share of public duties. At tho meeting of householders last evening, Mr W. Morgan, chairman of the High School Board of Governors, expressed regret that Mr Brown was retiring from the committee, and paid a high tribute to that gentleman for the interest showD and the assistance rendered in connection with the Teohnica! olussos.

Before tho Council meeting closed last evening Cr Kennedy said that as an old member of the Council he wished to take that opportunity to express his feeling of depression at departing from tho tabic. He bad only done so from private reasons which must prevail. He wished to stop on the Counoil because he was pervaded with strong opinions that Gisborne should be provided with water, drainage, and roads. He sincerely hoped that the new Council would follow strongly on the lines adopted by the Council in the past, and use every effort to secure up-to-date maobinery so that tho town oould bo supplied with cheap metal. He was pleased to see from tho return submitted that ovening that tho asphalting of Gludstone road had justified itself notwithstanding the fact that it had boon done under the most unfavorable circumstances. The work was an object lesson to the Council, and they should certainly go on with it. Referring to tho loan proposals, Cr Kennedy said that they could not expect to obtain the money under 5 per cent, and hB hoped to see them go right on with the work. When the Council came back for re-election in two years’ time they Bhould have the water close to, if not in, town. In retiring from the Counoil he wished to state that it was Mr Hay’s scheme, and not Mr Reynolds’, os Cr Lysnar would have them believe, that they had accepted. The question of tho appointment of an engineer would be one for the new Council to consider. He should have liked to have remained on the Counoil, and he hoped on some future occasion to be with them again.
