The polk proceeded against Whittingham for send ing beer out of Mataura, a no-lioense. dis - trict, into Clutha, also no-lieense, in ance of a written order from & customer! For the police it was contended that delivery of the goods took' place at Gort station, and was therefore in contravention of the law. His Honor, in a lengthy jadgmeat, held otherwise; ’and that the beei was not the property cf the consignee until it reached its. destination. In another appeal, His Honor held that Whittingham could not:appropriate"beer brewed hy,As\ and ordered through had established at Maudeville -in-a licensed district, the said beer being returned to a purchaser within the no-license district oi Mataura.
