AN EPISODE OP WIRTH’S CIRCUS

(Per Press Association.) Auckland, last night. On Friday last a case wqb called on in which Philip Wirth, one of the partners in Wirtbs oirous, summoned his leading cowboy, William McCloud, for assault, and asked that he might be bound over to keep the peace. The case was adjourned from Friday until Saturday morning, with the oonseut of both parties, i D order to see if the affair could be settled privately. On Saturday morning, however, it was stated that no agreement had been come to, and the case was further adjourned till Monday owing to pressure of Court work. After half the circus employers and both parties had'waited about the Court to-day at fifteen minutes past five, a quarter of an hour beforo the boat had to sail, Mr Skelton mentioned the case, and was informed by the magistrate that it certainly could not be heard then if the boat left at halfpast five. Mr Skelton then applied to the Magistrate that the case mfght be adjourned sine die. Mr lomden, who appeared for the cowboy, said he objected to the case beiDg adjourned sine die, as it had been practically agreed that the parties should shake hands, but when the precise moment came Wirth had refused to do so. The Magistrate said he would not adjourn a case like the present one aine die, but he would havo it called upon, and if the parties did not appear ho would order it to be struok out. Mr Lundun : “ Well, we will appear. ’ However, when the case was called upon at 20 minutes to 6 there was no appearance of either party, and the case was accordingly struck out. It was stated that there was a contract for 12 months between the parties, and that Mr Wirth could net dismiss defendant.
