Snrauol Kraotzor, a privato dctcotivr, was charged with perjury in giving evidence in a case of trespass on tho Wingatoru rsoecourso. Kraetzor, in giving ovidonoo, had alleged thnt Ijubv, who was then being proseoutod, had been in Ohristohurob in November and had aoted ns a bookmaker’s olerlc. Ho was not sure on tho point, but when olosely cross-examined said it was at the Novotuber meeting. -After hearing ovidenoo that Luby had not been out of Dunedin in November His 'Worship said ho was not satisfied there was prima facie evidence that Kraetzer swore falsely and, knew ho wus so doing with intent to “deceive tho oourt. The case would be .dismissed.
