The case against Nugent for a breach of the anti-strike law in connection with the recent strike at Newcastle broke down. Connsel for tho defence took the point that there was no industrial dispute shown as defined by tho Act. The Judge ruled that there was no evidence of an industrial dispute, and the prosecution failed. The case was dismissed. The Crown decided to prooeed on another case, which iB considered not covered by the Judge’s ruling.
