SUPREME COURT.

(Per Press Association ) Dunedin, last night. I In the Supreme Court to day judgment was given reversing the decision of the Magistrate in the case of E. D. Macassoy Iv. Patrick Lyons, of Tctnuka, in which tho plaintiff secured judgment for £i>2 10s commission in the lower Court. In tho civil action Warren v. McGavin and Co., brewers, wbero £ll3 5s was claimed for 1812 hours overtime alleged to have been worked, the Court held that tho plaintiff camo within the subsection of section 18 of the Factories Act exempting certain employees from the limits of tho working hours, and gavo judgment for tho defendants.

In tho divorce action Elizabeth IvlcCartia v. Justin McCartio, of New South Wales, journalist, the Court held that although adultery had been proved a decree had to bo refused on the ground that respondent’s domicile wa3 not in New Zealand, and therefore tho Court had no jurisdiction.
