At the Supreme Court to-day an action was be gun 'ey S. I\. Garrick against James Copeland for -specific performance and damages. Plaintiff alleges that on July 7 defendant sold him the Hosiorton Estate, '11,972 acres of freehold, for J 626.000, through Matson and Co. On July 30 defendant gave a notice repudiating the contract. . Plaintiff had already sold the whole property in lots to various purchasers i’be statement ot defence denies the claim entirely, and alleges that on June 20 defendant instructed Matson and Co. to sell the property in lots. On July 7 they informed him of the offer for Lots 3,4, and 5, but be refused to sell these without the rest. They suggested that Garrick, a brother-in law of members of the firm, and in their employ, would buy the whole property, and finally a sale was otfectod at Leicester, Matson’s house, late on the evening of July 7, James Goodman drawing up the agreement whereby defendant sold to Garrick for J;26,000. Hearing soon after that Matsons had had offers for blocks other than 3,4, and 5 when they induced him to sell to Garrick, defendant repudiated the contract on the ground that Matsons made fraudulent representation to him. The evidence of Goodman and defendant occupied the whole day. The case will be continued tomorrow.
