CHRISTCHURCH, last night. In the appeal case, Pitcaitlily and Co. against Backer, Judge Denniston gave judgment for respondent, who had been awarded £25 damages by the Magistrate, for being refused a passage in one of appellants’ vessels at.the usual fare. The Judge decided that appellants were liable on the 'ground of breach of contract. He also stated that appellants as common carriers were hound to receive respondent as a passenger. DUNEDIN, last night. The jury acquitted Moss in ‘ the gaming case to-day.
