WELLINGTON, last night. Argument on the motion to rescind tlie order giving leave to appeal in forma pauperis in the ease Mitchell v. tlie New Zealand Loan and Mercantile Agency Comuany and others, was concluded in the Court of Appeal this afternoon, and judgment was reserved.

The Court then heard the appeal from the decision of Justice Conolly in the case of Bews v. Bews and another. This was a petition for divorce in which tlie husband was petitioner. Petitioner and his wife had been separated, and petitioner, having reason to suspect the wife of misconduct, had watched the house in which she was Jiving, taking a friend with him a s a witness, and in this way had detected and obtained evidence of adultery fudge Conolly refused a ucorec of dissolution ...of marriage, holding that this conduct amounted to connivance on the part of the husband. Mr Baume appeared in support of tlie appeal, there being no appearance of respondent or co-respondent. After hearing Mr Baume, the Court unanimously allowed the appeal, and made a decree nisi for dissolution of marriage, to be made, absolute after three months, with costs £ls, and witnesses’ expenses and disbursements against the co-respondent.
