DECISION OF MAGISTRATE UPHELD.

Tho Appeal Court to day hoard the appeal in the case of tlie King v. Barnett. Defendant was convicted by the Stipendiary Magistrate at Christchurch of betting at totalisator odds, and lie moved in the Supreme Court at Christchurch to prohibit further proceedings, on the ground that there was no evidence before the Magistrate to support a conviction. Tho principal question raised was whether there was any evidenco that entry in the books of defendant showed that a bet appearing therefrom to have been made with one 11 Groper ” had been made with any real person, and whether there was any evidence of identity of “ Groper ” with one William Wales. Judge Deiiniston dismissed tho motion, holding that there was sufficient evidence on these points to support a conviction. Tho Court of Appeal, alter hearing Mr Skerrett for tho appellant, unanimously upheld this decision, and dismissed the appeals without ailing upon Mr Stringer, for the Crown.
