MALICIOUS PROSECUTION.

DAMAGES AWARDED. [By Telegraph—Prc3s Association]. Wellington, last night. During tho last three days the Supreme Court has been engaged hearing a claim for £5Ol damages for alleged malicious prosecution, brought by Robert Aitken against James B. Harcourt, land and estates agent. , The circumstances were that in March last plaintiff, who was salesman in defendant’s employ, was arrested on a warrant, charged with embezzling £9 4s lid. The charge was dismissed by the S.M. The plaintiff then instituted these proceedings. It appeared that Aitken had control of the cash box in Ilarcourt’s office, and of this cash box Harcourt’s son had a duplicate key. It was shown to have been the custom of Aitken to borrow money from tho petty cash as advances against salary and commission, giving 1.0.U.’5. for the amounts so borrowed, and it was out of an alleged discrepancy in the cash and these 1.0.U.’s that proceedings were first taken. The caso was concluded to-night, when the jury returned a verdict for Aitken for £350 .damages.
