A DILEMMA.
COLLEGE GOVERNORS IN A LEGAL FOG.

A rather curious position has arisen in regard to the action of the Canterbury College Board of Governors in leasing section 2254 and Medical School reserves at Westfield. Two tenders were received; one from F. D. E. Malet, executor of the late Archdeacon Wilson, and the other from C. J. Harper. Harper’s tender was a halfpenny higher than the other, but the Board accepted the lowest. The Act which' gives the Board the power to lease its lands provides that the rent shall be the best obtainable. Harper is, therefore, claiming that, as he was the highest tenderer, the Board must accept his tender or none. Meanwhile, Malet entered into possession. The Board has received a lawyer’s letter from both successful and unsuccessful candidates, threatening an action. It has been decided, on reconsideration, to adhere to the first decision in favor of Malet. It is likely, therefore, that a case will come before the Supreme Court. -
