JUSTICES’ JUSTICE.
(By Telegraph—Press Association.) Dunedin, last night. At tho Police Court a second charge against Peter Grant of making and entering into a bet upon the result of the New Zealand Cup race was proceeded with. The Crown Prosecutor said that ho would rely on the authority of Mr Justico Williams’ decision in tho case. After evidence had been taken, Mr Sim, for tho defence, said that what the Bench had to be satisfied about was whether, beyond all reasonable doubts, a bargain between Greaney and accused was a wager on tot-alisator odds. In the book Greaney was apparently credited with £7 10s, hut the dividend paid by tho totalisator was £9 Us. The difference showed that it was not a wager at totalisator odds. After some consultation between the Bench (composed of Mr Carew, S.M., and Messrs S. G. Smith and G. Christopher, Justices), in which the Magistrate appeared to take little part, Mr Carew said that the opinion of the Bench differed, and the case would be dismissed. Mr Fraser, Crown Prosecutor : Just so, tho Justices have over-ruled tho Magistrate. Ido not intend to proceed further. We are on the verge of a public scandal. Mr Carew said that Mr Fraser should not make these remarks.
Mr Smith, J.P., thought the remarks uncalled for. In each case the thing had not been proved. Tho other charges were adjourned till March 6th.
