DAMAGES FOR ACCIDENT.
PAINTER AWARDED £VSO AGAINST UNION COMPANY.

At tho Supremo Court Henry Wraysought to recover £250 damages from tho Union Steamship Company for an accident met with while in the employ of tho defendant company. The statement of claim set forth that plaintiff, while employed as a painter on tho Takapuna at tho patent slip on Juno 5, fell through a bunker hole, and sustained severe and permanent injuries to his left hip and right log. The liolo was nowly-mado while plaintiff was working on tho steamer, and he was not informed of it by anyone in tho employ of the company or superintending the work. Insufficient lighting—the accident occurred at night—and other grounds of negligence were alleged. The defence set up was that tho plaintiff was well aware of tho position of the bunker hole ; that all precautions were taken by the defendants, and if the plaintiff had used ordinary care the accident would not have occurcd. The jury returned a verdict for £l3O damages. Judgment was entered up accordingly with costs. Stay of execution was granted for fourteen days.
