In the House of Commons, Mr Balfourstated that owing to the critical attitude of the Opposition towards the measure, the Education Bill would be withdrawn this session, but Government would introduce a single-clause measure dealing with the emergency created by the Cockerton judgment, by giving control of secondary education to local authorities instead of School Boards. The judgment referred to 'was given b,y tho Queen’s Bench, the effect being that School Boards could not pay from School Board rates for 'science and art teaching in schools, 'or elementary teaching in evening schools to persons more than 161- years of age.
