ALLEGED LIBEL.
VERDICT FOR DEFENDANT. (By Telegraph—Press Association.) Dunedin, last night. Judge Williams and a jury of four are hearing a libel guit Dr Coughtrey against the Evening Star,in which £2OO damages is claimed for charging-him with cavilling over the tramway and other public concerns. Tho case O’Connor against Gebbic, another suit, was settled out of Court, defendants paying £65. It was an action for slander arising out of the despatch of telegrams. Later.—The Supreme Court was engaged all day with the libel case, Dr Caugbtrey against the Evening Star Company. The alleged libel was an article that appeared in April last, reflecting upon the conduct of tho plaintiff at tho meeting of the Tramway Company’s case. It resolved itself into two branches :
(1) As to the criticism in the article ; (2) statements which were proved not to be in accordance with fact, from which certain inferences were drawn. The jury gave a verdict that the statements were a fair criticism and written without malice, and as to the stqterqents not being in accordariceSyijih facts, that they were not libellous. A vordiet for defendant, with costs, ivas accordingly returned.
