POLICH COURT.
(Before Mr W. A. Barton, S.M.) IN THE SAME BOX. A chimney-sweep named Edward Bureli, against whom a prohibition order was taken out yesterday, made the following statement to tho Court opposing the order: —“ There are two sweeps in Poverty Bay, and I am in this position at the present. As a chimney-sweep I have been shut out from my work from the different public-
houses for twelve months, not being allowed to do anything for them. Then the other sweep has an order taken out against him. I tako his orders, and have now had three which I liavo attended to, and done the work properly. I have other work to do. lam thou shut out myself, and no one can go into a public-house to sweep a chimney. That is tho position. If tho law stops in and takes away my work I will have to fall back on my children, which God forbid.”—The Magistrate pointed out to tho defendant that it would cortainly be to his advantage that the order should bo made. ALLEGED ASSAULT.
The Court was occupied for somo time bearing a charge of assault brought by Donald Murray, clerk, of Gisborne, against A. Cruiksbank. Mr C. A. DcLautour appeared for tho defendant. Tho plaintiff, who conducted his own case, stated that he called at a shop where tho defendant was engaged, and asked to bo allowed to sec someone who was working on the premises. The defendant told him to clear out, and immediately came from behind the counter and put him out of the shop, throwing him on his back on tho footpath. Tho plaintiff was crossexamined by Mr DcLautour as to whether lie was not under tho influence of liquor upon tho occasion of his visit to the shop. This Murray denied, and called W. Miller, who stated that ho saw the plaintiff on the day in question, and lie appeared to bo sober. After hearing tho evidenco of tho defendant and another witness, the
Magistrate said that it appeared to him that the defendant had used no more foreo than was necessary to eject tho plaintiff from tho shop. Tho information was dismissed.
