Harbor Board Election-
The following is a copy of the petition filed on Saturday in connection with the Borough division of the Harbor Board election: —
I, the undersigned, Edward Pattricks Joyce, of Gisborne, agent, a candidate for the position of member of the Gisborne Harbor Board, and we, the undersigned, Donald Murray, of Gisborne, clerk, William L.. Buscke, of Gisborne, draughtsman, electors of the Borough of Gisborne, hereby declare that we verily believe that the election to the office of members of the Gisborne Harbor Board, holden at Gisborne on the eleventh day of February, 19Q1, at which William Pettie and James Whinray were declared to be duly elected to the said office, is void upon the following grounds: — 1. That voting papers were taken out of a ballot-box otherwise than is provided by the Act so as to affect the result of tho election.
2. That irregularities occurred in such election tending to defeat the fairness of the election (inter alia) — (a) The Returning Officer did not make up> from the voting papers deposited in the ballot-box the number of votes received by each candidate, but added to the number ' of both the candidates declared to be elected votes not so taken from such ballot box. (b) That the Returning Officer did in accordance with law declare the candidates' who had received the highest number of votes to be elected. , (c) That the candidates declared to be elected did not receive the highest number of votes. (d) That the Returning Officer voted at such election contrary to law.
3. That at least one person, to wit William James Quigley (Returning Officer), voted at such election who was not so entitled to voto. ; And we pray that enquiry may be made into the said electiqn under the provisions of “The Regulations of Local Elections Act, 1876,” and that the said election may be declared to be void. Given under our hands this 16th day. of February, one thousand nine hundred and Made and signed by Edward Pattricks Joyce, Donald Murray, and William L. Buscke, before me, J. Matthewson, a Justice of the Peace in and for the colony of New Zealand.
