CASE DISMISSED

SOLDIER IN CAR INTOXICATION CHARGE (Per Press Association.) AUCKLAND, this day. That he was a lover of animals and swerved sharply to avoid a cat, causing the car to capsize, was the defence advanced by Arthur Forbes Milne, aged 32, a soldier from Papakura military camp, in pleading not guilty to a charge of intoxication while in charge of a motor car.

After hearing the evidence, the Magistrate, Mr. C. R. On - Walker, dismissed the charge stating it must be remembered that Milne had been badly shaken and suffered a serious band injury, and also that the doctor who examined him at the hospital over two hours after the accident considered he showed no signs of intoxication
