LENGTHY LITIGATION FURTHER JUDGMENT FINDING CONFIRMED Judgment for the defendant, the Guardian Trust Company, has been given by Mr. Justice Callan on an application made to the court by the plaintiffs in the proceedings launched by the children of the late Frederick 'Hall against the Guardian Trust Company, the Union Bank of Australia, Limited, and the Bank of New Zealand.
The proceedings have not yet come to trial, but the plaintiffs applied to the court for an order to compel the defendant Guardian Trust Company to produce certain documents in its possession, and which were claimed by the company to be privileged and not liable to production. The application was dealt with by Mr. Justice Callan in Auckland and was rejected, His Honour finding that there were no grounds for the plaintiffs’ application. That order was made in chambers, and the plaintiffs being dissatisfied with it, applied to have the order reviewed. The application for review was heard in Auckland on December T 5, and decision was reserved. Judgment has been delivared now, confirming the earlier finding in favour of the defendant, and dismissing the plaintiffs’ application.
At the hearing in Auckland Mr. W. D. Lysnar appeared for the plaintiffs, and Mr. H. P. Richmond, with him Mr. J. G. 'Nolan, for the Guardian Trust Company.
