NEW TRIAL ORDERED
JURY MISDIRECTED APPEAL COURT RULING j (Per Press Association.) WELLINGTON, this day. The court of appeal delivered judg- 1 ment to-day in the appeal Ronald j George Orr, Auckland, against Wii- i liam Ancell Reynolds, Auckland. The court held that the trial judge, | Mr. Justice Fair, in the manner in j which he placed the issues to the j jury at the trial had misdirected it, i with the result that a miscarriage of j justice may possibly have occurred. That being so, a new trial of the action j was ordered to take place at the next > sitting of the Supreme Court at Auck- ] land. The court was unanimous. ■ Mr. Justice Ostler, however, ex- j pressed the opinion that no evidence 1 of negligence on the part of Orr had been produced at the trial and that the case should have been withdrawn from the jury, but as other members j of the court considered a new trial'! to be the proper order to make, he j agreed with that course.
