Use of Drunk-O-Meter
THE new traffic code in Indiana, 1 U.S.A., embraces two additions to the statutes of vital importance to motorists.
One legalises the use of the drunk-c-meter, and the other adds a new offence—reckless homicide. Although courts- generally have held that drunk-o-meter tests are admissible in evidence, Indiana thus becomes the first State to legalise its use. The alcoholic content'd the blood, as determined by the drunk-o-mejer hereafter will determine whether or not a driver is drunk. The charge of involuntary manslaughter governs the killing cf a person during the commission c; an unlawful act, the penalty for which is one to ten years, Reckless homicide was written into the statutes to provide for prosecution 'of drivers who kill while violating no law other than traffic codes. The new law provides fo r a maximum penalty of from one to five years in the penitentiary and a fine of £250 or both, or a penal farm sentence of from CO days to six mor. as, and a fine of £25 Or both.
