WALKED INTO BY FARMER
Reserved judgment for plaintiff for the 'full amount claimed was given in the Taihape Magistrate’s Court toy Mr. R. M. Watson, S.M., in the case in which J. E. Hamill, of Rotorua, and S. W. Keats, of Taihape, sought to recover £4O from Charles Leary, farmer, of Taihaipe. The claim was to cover the cost of replacing a window in H. Bc'water’s radio shop, which was broken by Leary, who -walked into the window as he was leaving the premises.
The magistrate ruled that Leary was negligent in not keeping -a proper look out as he was leaving Bowater’s shop, and that his negligence had resulted in the window (being smashed. Hamell is the owner of the building, and Keats the lessee. Kea'ts sub-let portion of the premises to (80-water.
The case is believed to be without parallel in -New Zealand legal history.
