NOXIOUS THINGS ALLEGED

CHARGES OF SUPPLYING CASE SENT FOR TRIAL (Per Press Association.) NEW PLYMOUTH, this day. Arguments that the charges should be dismissed were not accepted by the Magistrate, Mr. W. 11. Woodward, at New Plymouth last night,, when he found that a prima facie case had been proved against a business man alleged to have unlawfully supplied a married woman with noxious things, to wit pills and medicines, with intent to procure a miscarriage. The accused was committed for trial Jo the coming session, of the Supreme Court. His name was again suppressed and h e was re-admitted to bail of £2OO. There were three informations, the first alleging that the accused caused the woman to take certain noxious things, the second alleging that he supplied them and the third alleging that hg attempted to supply them.

Evidence 6f visits to the accused's shop was given by the woman concerned, who was the woman involved in a case heard against another New Plymouth resident earlier in the day. She said that she received from the accused pills and medicine with instructions for their use, but they had no effect. The accused mentioned to her and her husband, who accompanied her at one time, the name of a drug contained in the medicine. The woman’s husband in evidence recalled Writing a note to the accused asking him to give Ihe bearer something <to bring about a miscarriage.

Evidence of the purpose and effect of the drug mentioned by the woman was given by Dr. G. H. Thomson, and Detective A. Jenvey described an interview with the accused, who denied all knowledge of the woman. Mr. I. W. B. Roy, counsel for the accused, asked the magistrate to dismiss the charges on the ground that the evidence offered was not sufficient to put a man on his trial, but Mr. Woodward held that a prima facie case had been established.
