PUBLIC TRUST CLAIM guardian TRUST CO. (Per Press Association.) WELLINGTON, this day. Reserved decision was delivered today Iby the Court of Appeal in an appeal by the Public Trustee against the Guardian Trust and Executois Company of New Zealand, Limited, heard on April 3, 4 and 5 last. By a majority of four judges to one. the court to-day reversed the decision of Mr. Justice Northcroft delivered at Christchurch on July 28, 1938, and entered judgment for the sum of £B4ao and costs against the Guardian Trust in respect of the legacies paid by it out of the estate of Elizabeth Smith, Christchurch, which legacies the Public Trustee alleged had been improperly paid. Conditional leave to appeal to the Privy Council was allowed to the Guardian Trust.
