THE QUESTION OF PENALTIES

Dunedin, November 18.
A case was heard before the Supreme Court to-day, in which M'Gregor and Company, engineers, claimed £IOOO from the United Gold Dredging Company, for breach of contract to supply machinery for the dredge for the Company's claim.
The contract was let in the boom time and was to be completed by May 21st, 1901. Six days before that the plaintiffs «a?ked for a certificate or progress payment, and received a reply that a certificate would not be given, as the Company treated the contract as abandonee 1 . Mr Justice Williams refused a nonsuit at the stage asked for, on the ground that time was the essence of the contract as he thought from the documents such was the case.
The jury gave a verdict for £350 of profit and £3OO loss on material; but the judgment hinges on several law points to be yet argued.
