GREY MAGISTRATE’S COURT.
Tuesday, August 20th,
(Before E. S. Hawkins, Esq., S.M.) Sutherland v, Cornish. —Claim for £5 8s for board and lodging ; judgment for > plaintiff with costs.
Moss and v. J. M'Gain. —Claim for £9 for commission on sale of property. Mr Hannan for plaintiff and Mr Wake for defendant. This was a somewhat involved case. The defendant instructed Moss and Co to sell his property and the latter had practically arranged with Hogan for the purchase when a hitch cropped up as to the finding of the money. Subsequently Mr Harley arranged to advance the money to Mr Hogan for the purchase of the property, and the transfer was * ultimately effected through the latter. Defendant, according to the evidence, had not withdrawn the property from plaintiff’s hands. The Magistrate, in giving judgment for plaintiff, said there could be no doubt but that Hogan was the purchaser and that Moss and Co., in the first instance, brought about the transaction, and were clearly entitled to their commission. The verdict was, therefore, judgment for plaintiff with costs.
