IMPORTANT DREDGING CASE.

Dunedin, Aug. 20. A ease in which great interest was taken by all connected witn dredging was eoneluded in the Supreme Court to-day, after extending over three days. The case was Gutten Bros, (consulting engineers) v. Globe Gold Dredging Co. to recover £ll3 8s 6d commission, to which a counter claim was put in. Cutten Bros were engaged to prepare plans for the removal and re-erection of a current wheel dredge afterwards converted into a steam dredge, from the Molyneux to the Waikaka. The counter claim was for alleged negligence on the part of the plaintiffs whereby defendants suffered to the extent of £450, which sum was claimed as a set-off for the alleged ’negligence, which included the delaying of plans by which time was lost, and tbe want of proper supervision, and not including various things in the specifications. It was stated, but not proved, during the case, that the engineers declined to give evidence for defendant.

The jury gave a verdict for the Globe Company in the claim and counter-claim, giving £5 damages in the .latter. Judgement was entered up with costs, but execution was stayed for two days in order to move for a new trial as the verdict was against the weight of evidence.
