Dr Dolisle sued the New Zealand Accident Insurance Company for £9B compensation for disablement by accident. The defence contended that the action was not brought within the six months stipulated by the policy. Plaintiff’s counsel argued that the clause was ultra vires as the accident might be so serious that the sufferer could not estimate his claim within six months and further that the Company had waived the right by continuing negotiations after six months had expired. Judgment was reserved.
