Kettle, met at 12 30, and adjourned till 1 30 p.m. The Board met at 1 30 p m, and adjourned to enable the Chairman to appoint an acting clerk. On the Board resuming, the Chairman appointed Mr J. W. Bines. The Board approved of the Chairman’s action. Messrs John Foster, M, Hall, O. Daly handed in their authority to appear on behalf cf tho Blackball Miners’ Onion of Workers.

The Blackball Coal Company was not represented,

Proposed by Mr Kettle, seconded by Mr Coppersmith, that the Board issue a,

summons to compel Mr Joseph Scott to appear before the Board to answer as to t7ie failure of the Blackball Coal Company not being represented before the Board, and also to give any further evidence required, The Board adjourned until Mr Scots attended. On the Board resuming, Mr Scott was interrogated as to the failure of the Company in not being represented. He stated that the Company had not been properly served with the reference filed with the Clerk of Awards with the Miners’ Union, and notice of the meeting of the Board was not served by the Cleric of Awards, inasmuch as the notice was i received by him, who was a servant of ' the Company, and not at the registered office of the Company.

The Miners’ Union requested the Board to adjourn to allow the representatives of the Union to get legal opinion as to the point raised by Mr Scott. Proposed by Mr Kettle, seconded by Mr M'Kay, that the Board adjourn for half an hour. Carried.

On the Board resuming, Mr Poster, one of the representatives of the Union, stated that after consulting their solicitor, the Union had decided to ask the Board to withdraw the case. The Board con-

sented to the request of the Union and the dispute was accordingly withdrawn.
