CRIMINAL LIBEL.
(PES PGFSS ASSOCIATION.)
Wellington, May 8.
At the Supreme Court to-day Thomas H. Mabin appeared to answer an indictment for criminal libel. Ho pleaded not guilty and said that he wished to conduct his own case.
The Chief Justice remarked that he had grave doubts whether or not the caso wouH be proceeded with, though that would not affect the civil liability if there was any. There was no decision by a judge in New Zealand delivered after argument, that an indictment for criminal libel would lie in view of the change which had taken place in the law since 1b93. The accused, on His Honor'a suggestion, raised the objection that the indictment did not show any offence. Sir Robert Stout then ruled in support of this objection, but reserved the point for the Court Appeal. Accused was discharged subject to any order that the higher Court may make.
