A PECULIAR CASE.
[per press association.]
Wellington, May 3
A Cninese named Fong Lee was arrested some days ago on a charge of indecently assaulting a girl under 14 years of age and remanded. On the case being called on in the S. M. Court this morning, it transpired that the child had in the meantime been married to the defendant while he was on bail. The officer of police applied for a further remand to allow him to take legal advice as to the position. Counsel for accused, while not opposing the remand if the police proposed to support the charge with indepeudant evidence, contended that before the remand was made the prosecution should admit that the girl was now married to the accused, and was not competent as a witness against him. The police doubted whether the marriage was legal. Counsel said that the consent of the parents had been given, and in that case any girl over 12 years or any boy over 14 could legally marry. A week’s remand was granted.
