Thk election for the first Council under the Municipal Corporations Act, 1900, will bo held to-morrow, and it is provided that the elections must be carried out under the provisions of the Regulation of Local Elections Act, 1876, clause 9 of which says:—"The voting papers shall be printed on white paper and shall be in the form in the Fourth Schedule and shall have nothing thereon either written or printed except as in such form and as hereinafter printed." The Fourth Schedule form of voting paper after the names of the candidates, goes on as follows :—" N.B.—The voter must draw a line through the names of each candidate for whom ho desires not to vote. Ho must leave only nine names uncancelled or the voting paper will be invalid." As thero was a doubt in some persons minds as to the meaning of the word only, the following question was submitted to Mr. Hannan. Whether at the present election for the return of nine Councillors a voter can validly leave less than nine names uncancelled on his ballot paper. In reply Mr. Hannan is of opinion that voters may vote for nine or any number less than nine, consequently all ballot papers having uncancelled not more than nine names will be in order. The attention of all persons having .the residential qualification is particularly drawn to clause 3 sub-section (5) of the Regulations gazetted January 17th., 1001, as follows .—" He (the Town Clerk) shall omit the name of every persons enrolled in virtue of a residential qualification, who, not being a candidate at such election, appears from a comparison of the rolls used at any election of a Mayor or Councillor not to have voted thereat." Persons who do not vote at to-morrow's election on the residential qualification will therefore be struck off the roll and must apply again for reinstatement.
