GREY MAGISTRATE'S COURT.

Monday, March 25th,

(Before E. S. Hawkins, Esq., S. M.)

C. Smith v. R. Armstrong.-— Chum for £1 14s 8d for goods supplied. No appearance of defendant; judgment for plaintiff by default with costs. J. Hillicr v. J. Jacobs.—This was a continuation of the case from last Court day, in which plaintiff laid an information against the defendant for building upon the public road to the detriment and inconvenience of the plaintiff. Mr. Guinness appeared for the informant mid Mr. Hannan for the defendant. fhe plaintiff, in his evidence, stated that defendant had erected six buildings on the roadway since ISD6. V\ illows, also, were allowed to grow, which struck the plaintiff on the face as he passed Mr. Hannan, for the defence, maintained that no criminal information could lie. That the pegs had been shifted since Mr. M‘Farlane’s survey; but, even if this was not so, the buildings were well back from the metalled road and did not in any way interfere with the traffic. The action was merely the result of ill-feeling. Mr. Guinness quoted several authorities in support of his case, and maintained that grievous injury was being done to his client. The Magistrate said the case was scarcely one for criminal proceedings, but in any case he would rule ho had no jurisdiction and would dismiss the information.

County Council v. Dillon—For plying on County roads without a license. Mr Hannan for plaintiffs and Mr Guinness for defendant. This case was dismissed on the ground of the river bed not being a County road, Mr Guinness objecting to his client being put in the witness box and the Magistrate sustaining the objection.

A domestic row from Te Kinga between a man and his wife was, after hearing, dismissed, both evidently being to blame, and the Magistrate holding that they could best patch up their dispute without foreign intervention.

W. Shanahan for behaving in a railway carriage in a manner calculated to cause annoyance was fined 5/- and costs.

J. Carl for using, insulting language ivas fined £1 and costs.-
