(per phess association.) Wanganui, Feb. 26. In the Supremo Court this afternoon fl T Fitzherbert mentioned that he had received a telegram from Mr Bell, Crown Prosecutor, Wellington, and another from Mr Skerrett, asking him to request Justice Edwards to deliver ths judgement of the Supreme Court in the LillywbiteBlateh extradition case. The Court was moved for the motion for a writ of Hahoaa Corpus with a view to discharging the prisoner Lilly white from custody, he havh> been committed by the magistrate »t Wellington under the provisions of the iWive Offenders Act, 1881. Justice Edwards first delivered the judgement of the Chief Justice, with which ho disB«nted, and then read his own judgment

which was contrary to that of the Chief Justioe. The opinion of the Court being divided, the result presumably will be that an order on the motion of a rule absolute will not be made, and the prisoner will not be extradited in accord- | ance with the decision of the magistrate Lillywhite, who is oharged with the Colchester murder, has determined that if the authorities refuse to convey him to England via Vancouver he will consent to be taksn home by the next direct steamer. The case against Henry Roberts, for alleged rape, was heard. Accused was practically charged with having, after ascertaining that the woman s husband was away from home, called at a house in Mangaweka late at night and awakened the woman and told her that he had brought a parcel for her from her husband. He gained admission to the house and committed a criminal assault. No evidence was called for the defence. After hearing the evidence the jury retired at 4 o'block, and, not having agreed at 8 o'clock, were discharged. The case will be re-heard. Duneein, Februaoy 26. At the Supreme Court James White and Frank Watson were arraigned on the charge of attempting to steal from J. A. Braithwaite £lO9 133 4d in money. White, who was out on bail, did not appear, and his bail was estreated. In Watson's case the jury returned a verdict of not guilty and accused was discharged.
