o Afc the Palmerston S.M. Court yestercay the case E. B. Pearcc v. C. C. Lindsay, claim .£SO commission on the sale of a farm was heard. Mr Cathro for the defendant. From the evidence produced it appeared thafc defendant had placed his four hundred acre farm at Apiti in the hands of the plaintiff for sale, and end the amount claimed was agreed upou as the commission. The farm was subsequently sold to Mr J. ii. Hewitt for i.'s per acre, and immediately afterwards the defendant wired to Mr Pearce withdrawing tlie farm from sale owing to defendant himself having sold it at a higher figure Mr Hewitt's purchase, however, had been completed, and defendant subsequently gave Mr Hewitt £76 to withdraw all claims to the section which Hewitt agreed to do. For tlie defence it was advanced that Mr Pearce having boon instructed to sell at L 5 5s per acre had exceeded his authority by selling at £5 per acre. H's Worship after hearing the evidence stated that the case was very clear, and he had no hesitation in giving judgment for the plaintiff for the amount cluim'ed. He considered that no commission agent could have acted other than Mr Pearce had dove throughout.
