The Ryley Bankruptcy.
(Per Press Association.) Dunedin, July 29. The hearing of a test case in connection with the bankruptcy of J. Ryley, trading as R. Anderson and Co., was commenced today, when application was made before Mr Justice Williams for a summons for the delivery of flour. Swanrich gave Ryley's traveller an order for 40 tons ot flour at £9 per ton, delivered at Lawrence in parcels of not less than three tons a month. He paid by cheque, 3jjd per cent discount being gllowed. He received a few tons, and got store warrants for the remainder. Ryley instructed that the flour so disposed of be set; apart and branded, and this was done, but on the same evening the mill was taken possession of by the Colonial Bank's bailiff, and when Swanrick sent an order for the further instalment of his flour the Deputy Official Assignee refused to give delivery. It was pointed out that in these cases the Bank got; the money for toe flour, and also the flour as secured creditor, or at the rate of 40s in the £, while unless delivery was given, Swanrick, as unsecured creditor, would probably get nothing. Evidence was taken to show tbe transaction was ta accordance with trade oaßtom. The case was not con- ! eluded when the court rose.
