Q ■ (Per Press Association.) Wellington, May 21. In the case re Delworth the Court dismissed tbe appeal from the decision of Judge Connolly. The testator bequeathed funds for a Delworth Institute for the education and maintenance of boys of parents in poor or straightened circumstances, to be brought up in the doctrines of the Church of England. The Appeal Court held this bequest was liable to succession duty, and was not within the Charitable Gifts Duties Exemption Act of 1883, the interpretation clause in that Act being intended to be exclusive though inclusive only in form. Leave was granted to appeal to the Privy Council on the usual terms.
