Appeal Court.
(Per Press Association). Westport, May 14. In the Appeal Court argument i« proceeding in the case Fanzelow v. Kerr. The motion is for a nonsuit or a new trial in an action for malicious prosecution. The plaintiff had been charged with stealing sheep and was . acquitted, and he brought an action against Kerr, the jury awarding him £300. The defendant contends he did not direct the prosecution, and that the information was laid by the Sergeant of Police.
